We offer free on-site consultations and written estimates for projects within our service area in The Woodlands and the surrounding Houston area.

An estimate is a good-faith projection of the cost and timeline of a project based on the conditions observed during the consultation. Estimates are valid for thirty (30) days from the date issued unless otherwise stated in writing.

Final project costs may differ from the original estimate if scope changes are requested, if unforeseen site conditions are discovered during the project (such as buried debris, drainage issues, or root systems), or if material costs change before work begins.

When you accept a written estimate and we begin work on your project, a binding service agreement is formed between you and FM Landscaping & Hardscape LLC. The estimate and any signed agreement form the official scope of work.

Any changes to the scope of work after a project has been approved must be agreed to in writing by both parties. Change orders may result in additional charges and adjusted timelines.

We will make every reasonable effort to complete projects within the agreed timeline. Weather, material availability, and unforeseen site conditions can affect timelines, and we will keep you informed of any delays.

Payment terms are outlined in your individual project estimate or service agreement. Standard practice for most projects is:

• A deposit may be required before work begins on larger projects
• Progress payments may be required at agreed milestones for multi-phase work
• Final payment is due upon project completion and your final walkthrough approval

Accepted payment methods will be specified in your project agreement. Late payments may be subject to interest charges or collection costs at our discretion and as permitted by Texas law.

We stand behind the quality of every project we complete. If a defect arises from our workmanship within a reasonable period after project completion, we will return to address and remedy the issue at no additional labor cost to you.

Our workmanship guarantee does not cover:

• Damage caused by acts of nature, severe weather, flooding, or natural settling beyond standard tolerances
• Damage caused by the homeowner, third parties, or improper maintenance
• Normal wear and tear, fading, or seasonal changes in living materials such as plants, sod, or turf
• Defects in manufacturer-supplied materials (covered under each manufacturer's separate warranty)
• Modifications, additions, or alterations made to our work by anyone other than us

Specific warranty terms for your project, including the warranty period for workmanship and any manufacturer warranties for materials, will be provided in your project agreement.

You agree to provide our crew with reasonable access to your property during scheduled work hours. You are responsible for marking or identifying any private utility lines, irrigation systems, sprinkler heads, or other underground features not covered by public utility marking services.

We will use reasonable care to avoid damaging existing landscaping, structures, or improvements during a project. Some incidental disturbance is normal during landscape work, and we will restore the site to a clean condition at project completion.

If existing conditions are discovered during the project that affect the scope of work, we will pause and discuss options with you before proceeding.

To the maximum extent permitted by Texas law, FM Landscaping & Hardscape LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of our website or our services.

Our total liability for any claim related to a project will not exceed the total amount you paid us for that specific project.

Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.

All content on our website — including text, photos, graphics, logos, designs, and other materials — is the property of FM Landscaping & Hardscape LLC or our licensors and is protected by copyright and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our website content without our prior written permission. Photos of completed projects on our website may be used by us for marketing, portfolio, and educational purposes.

You may cancel a scheduled consultation at any time before the appointment without penalty.

If a project has been scheduled and materials have been ordered or work has begun, cancellation may result in charges for materials already purchased, labor performed, or scheduling losses. Specific cancellation terms will be outlined in your project agreement.

Refunds for deposits or payments will be addressed on a case-by-case basis depending on the work completed and materials purchased at the time of cancellation.

These Terms and any agreements between us are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any dispute arising from or related to our services or these Terms will be resolved in the state or federal courts located in Montgomery County or Harris County, Texas.

Before initiating any legal action, both parties agree to attempt in good faith to resolve disputes through direct communication. Contact us using the information at the bottom of this page if you have a concern about our services.

If any provision of these Terms is found by a court to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
